From later reports it seems it's Murdoch who wants to settle out of court, whereas Dominion want a public trial to make a point as too much is brushed under the carpet with Trump issues.

I am presuming (purely a guess) that Fox would want to settle with no public admission of fault and a non-disclosure agreement barring discussing the details of the settlement, which doesn't serve Dominions broader interests. From a financial standpoint, settling is often the way to go for companies, but I would say specifically with this issue, settling would not be in their best interests under those terms.
